28th Feb 2018

Q: I was cruising in the HOV lane with two passengers when, suddenly, a CHP SUV with lights flashing came up about a half-mile behind me. What is the proper procedure in this situation? Get out of his way by crossing the double-yellow lines? Continue until the next possible exit?

M.G., Torrance

A: Although California Vehicle Code Section 21655.8 clearly states that “no person driving a vehicle in the HOV lane may cross over the double lines to enter or exit,” a subsection allows for this exception: “Upon the approach of an authorized emergency vehicle displaying a red light or siren … a person driving a vehicle in an exclusive or preferential use lane shall exit that lane immediately upon determining that the exit can be accomplished with reasonable safety.”

In other words, you get out of the way, even if it means crossing the double lines, if doing so can be done with reasonable safety.

Q: Can motorcycles use HOV lanes?

D.M., Lawndale

A: Yes, and without a decal unless otherwise posted. Motorcyclists, however, cannot ride in, on or over solid double lines.

Q: We are taking a vacation in California with a trailer hitched to our car, and wonder if we can use the HOV lanes.

H.P., Long Beach

A: The CHP indicates that any vehicle towing a trailer, and subject to a speed limit of 55 mph, cannot use an HOV lane regardless of the number of occupants.
